The protection for active members within 13 years of their Legacy Scheme Normal Pension Age on 31 March 2012 to stay in their Legacy Scheme for longer, so moving to the 2015 Scheme later than 1 April 2015 if moving at all.
As members were treated differently depending on their age, this was found to be illegal age discrimination. There were 2 types of Transitional Protection, Full Protection (within 10 years of NPA) and Taper Protection (within 10 to 13 years of NPA). Transitional Protection members will still have the choice between their Legacy Scheme and the 2015 Scheme for the Remedy Period.
