Protection for active members with between 10 years and 13 years to their Legacy Scheme Normal Pension Age on 31 March 2012 to stay in their Legacy Scheme for longer, so moving to the 2015 Scheme later than 1 April 2015. That means a Date of Birth between 1 April 1957 and 31 March 1960 for the 2008 Scheme and between 1 April 1962 and 31 March 1965 for the 1995 Scheme.

As members were treated differently depending on their age, this was found to be illegal age discrimination. There were 2 types of Transitional Protection, the other type is Full Protection for active members with within 10 of their Normal Pension Age on 1 April 2012. Transitional Protection members will still have the choice between their Legacy Scheme and the 2015 Scheme for the Remedy Period.
