Protection for active members within 10 years of their Legacy Scheme Normal Pension Age on 31 March 2012 to stay in their Legacy Scheme, so moving to the 2015 Scheme later than 1 April 2015. That means a Date of Birth before 1 April 1957 for the 2008 Scheme and before 1 April 1962 for the 1995 Scheme.
As members were treated differently depending on their age, this was found to be illegal age discrimination. There were 2 types of Transitional Protection, the other type is Taper Protection for active members with between 10 and 13 years to their Normal Pension Age on 1 April 2012. Transitional Protection members will still have the choice between their Legacy Scheme and the 2015 Scheme for the Remedy Period.
